The legal situation: Is Kratom legal?

Kratom is legal or at least not explicitly banned in many countries around the world. In Germany, kratom is not approved as a medicine, but not as a medicine either Narcotics classified. This means that the possession and consumption of Kratom is not punishable. 

Kratom is 100% legal in Germany.

However, it is important to emphasize that the legal assessment of so-called new psychoactive substances (NPS) is subject to constant change and kratom in particular has been on the agenda of the responsible expert committee of the Federal Institute for Drugs and Medical Devices several times. Until the Higher Regional Court in Cologne on September 11, 2015 , it was assumed that Kratom could be subject to the Medicines Act and could therefore only be sold legally under very specific conditions. The warning on many products is purely a precautionary measure and legal safeguard to protect retailers.
